PRESALE TERMS & CONDITIONS
IMPORTANT NOTICE
PLEASE READ THESE PRESALE TERMS CAREFULLY BEFORE PURCHASING AN EARLY BIRD MEMBERSHIP. BY PURCHASING AN EARLY BIRD MEMBERSHIP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS.
Zoomies is not currently open for business. The facility is currently in the planning and development stage. By purchasing an Early Bird Membership, you acknowledge and understand that you are purchasing a membership for a facility that is not yet operational and that access to the facility and its services will not be available until Zoomies officially opens.
Zoomies is targeting a grand opening in Summer 2026. This target opening date is an estimate only and is subject to change without notice. The actual opening date may be earlier or later than anticipated due to factors including, but not limited to:
• Construction delays
• Permitting or licensing delays
• Supply chain disruptions
• Financing or funding changes
• Regulatory requirements
• Force majeure events
• Other circumstances beyond Zoomies’ reasonable control
Zoomies makes no guarantee, representation, or warranty regarding the actual opening date and shall not be liable for any damages, losses, or expenses arising from delays in opening the facility.
Zoomies will make reasonable efforts to keep Early Bird Members informed of progress toward opening through email updates, social media posts, and website announcements. However, Zoomies is under no obligation to provide updates at any specific frequency or time. Members are encouraged to follow Zoomies on social media and check the website periodically for the latest information.
Your Early Bird Membership will not automatically activate when Zoomies opens. You must activate your membership within one (1) year of Zoomies’ official grand opening date. Activation instructions will be sent to you via email once the facility opens.
Upon activation, your membership term will begin. Important: Automatic renewal and recurring billing will NOT commence until AFTER your membership is activated upon opening. During the pre-opening period, you will not be charged any recurring membership fees. Your billing will only begin on the first billing cycle following your membership activation.
4.1 Membership Expiration & Forfeiture
If you do not activate your membership within one (1) year of the grand opening date, your Early Bird Membership will expire.
Zoomies will send you email reminders before your membership expires: (1) a reminder at least sixty (60) days before expiration, and (2) a final reminder at least thirty (30) days before expiration. These reminders will include instructions on how to activate your membership and your deadline. If you fail to activate your membership by the expiration date despite receiving these notifications, your Early Bird Membership will expire and you will forfeit your membership fee. No refunds will be issued for memberships that expire due to failure to activate within the one-year window.
Refunds are available upon request at any time prior to Zoomies’ official opening, regardless of how long the pre-opening period may extend. Refunds will be issued minus credit card processing fees (3% plus $0.20). We are committed to building something you’ll love, and we want you to feel confident in your early support. You may request a refund of your Early Bird Membership fee at any time before the facility opens.
To request a refund, please email info@zoomieschicago.com with your name and membership details. Refunds will be processed within thirty (30) business days of receipt of your refund request.
Once Zoomies officially opens and your membership is activated, the standard refund and cancellation policies outlined in the Membership Agreement will apply.
5.1 Separate Account for Early Bird Funds
Early Bird membership funds are maintained separately from general operating accounts and are reserved for membership activation or refund prior to opening. This ensures that your Early Bird Membership fee is preserved and available for either membership activation or refund.
As an Early Bird Member, you are receiving exclusive discounted pricing not available to the general public after Zoomies opens. Early Bird Members may also receive additional benefits such as priority access, special events, or promotional offers as determined by Zoomies in its sole discretion. Early Bird benefits are subject to change and are not guaranteed.
This Early Bird Membership purchase is entirely voluntary and optional. Zoomies does not require you to purchase an Early Bird Membership in order to become a member once the facility opens. You may alternatively purchase a standard membership after the facility opens at the then-current rates if you prefer. This presale offering is a special promotional opportunity and is not essential or required to access Zoomies’ services.
Zoomies reserves the right to modify, change, or alter the planned services, amenities, features, layout, design, or any other aspect of the facility prior to opening.
While Zoomies will make reasonable efforts to provide the services and facilities as described, the final facility may differ from promotional materials, renderings, descriptions, or representations made prior to opening.
You acknowledge and agree that you are not relying on any renderings, architectural drawings, marketing materials, social media posts, website descriptions, promotional videos, or other preliminary content in making your decision to purchase an Early Bird Membership.
You understand that the final facility, layout, amenities, and services may differ materially from any preliminary descriptions, images, projections, or representations. The rendering of the facility and any marketing materials are conceptual and aspirational in nature and are not representations or warranties of the final product.
You are purchasing an Early Bird Membership based solely on these Presale Terms & Conditions and your willingness to support Zoomies’ vision, with the understanding that the final facility may differ from preliminary marketing.
By purchasing an Early Bird Membership, you agree to be bound by the Zoomies Membership Agreement and all other applicable policies, rules, and terms once the facility opens. Prior to your first visit, you will be required to complete the Registration & Temperament Assessment and sign the Liability Waiver & Release. All terms and conditions of the Membership Agreement will apply once your membership is activated upon opening.
To the fullest extent permitted by law, Zoomies, its owners, officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
Additionally, to the fullest extent permitted by applicable Illinois law, Zoomies’s total liability for any and all direct damages arising out of your Early Bird Membership purchase or these Presale Terms & Conditions shall not exceed the total amount you paid for your Early Bird Membership fee. This liability cap applies to claims arising from (a) delays in opening the facility; (b) changes to the facility, services, or amenities; (c) inability to open the facility; (d) failure of the final facility to match preliminary renderings or marketing materials; or (e) any other matter related to the Early Bird Membership or presale purchase.
Three documents will govern your membership at different stages:
These Presale Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.
If any provision of these Presale Terms & Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect and enforceable.
These Presale Terms & Conditions, together with the Membership Agreement (upon activation), constitute the entire agreement between you and Zoomies regarding your Early Bird Membership purchase.
